      Hello, the account owner would be in control of all these items. If you use your Self-Directed IRA to make a private money loan, you would be in control of managing and overseeing the asset.

    How do I take property(not sold property) out of my self directed IRA?

      Hello, thank you for the question! You would need to get an appraisal to establish the value, which is the value that would be reported as the distribution. The property would be distributed to you, requiring a deed transfer from the IRA, to your personally. This would require you to record the new deed with the respective county recorder. If the property is held in a pre-tax account (Traditional IRA) you will pay taxes on the amount you distribute (value of the property). If you are under 59 ½ years of age, you would have a 10% penalty and taxes. If a Roth IRA, the account has been seasoned for 5 years, and you are over the age of 59 ½, you should incur no taxes as the Roth IRA grows tax-free and qualified distributions are tax-free. Consider discussing with a tax advisor why you might distribute the property instead of keeping it in your IRA for tax advantages.

    I don't understand your last example. The guys ownership was less then 50% but they still popped him. How are you suppose to structure and investment in an LLC and your profit then?

      Thank you for the question. It is a grey area anytime someone uses their IRA funds and invests in an LLC or other partnership, corporation, or trust, whereby there are disqualified persons involved, including the account owner. If an IRA is investing in an LLC,Corp, etc., whereby the account owner, nor any other disqualified persons is involved, should not be an issue. The overarching concept is that the IRA cannot be used to benefit oneself in the here an now, nor any other disqualified persons. The IRA must be used to benefit the IRA solely. Then in the future the account owner, during retirement (59.5 years of age and beyond) can enjoy the distributions. These accounts have tax-advantages, and along with this are governing rules set forth by the provision of the tax code, namely IRC 4975. Always best to consult with a tax-professional as you engage in transactions.

    I don’t disagree that a Roth is a good investment with the right fact pattern. A couple of thoughts on your first example of contribution to a Roth and getting 10% growing to $650k compared to a taxable account. You assume paying taxes annually on all the income, however if invested in equities (a likely choice if you are going to achieve 10% growth) you only pay tax if you sell which changes the math. Secondly, if instead of a taxable account you did the more likely comparison with a tax deferred vehicle, all other variables as you stated, your balance would be $812,500 or $162,500 more than the Roth. You (or your heirs) will eventually have to pay tax on that balance, thus the tax you ultimately pay will determine the better choice.

Absolutely, we always like to say, we are one member of your financial team and you should always analyze through your own lens, based on your investment strategies, which type of account is best for you, or a combination of both pre-tax and Roth accounts. Many arguments can be made for and against Roth savings, but the important point to make is that the withdrawals within retirement, assuming all rules are followed are 100% tax-free. The purpose of the content is to educate folks on Roth savings, much of which we find is not always available in other forums. Most are worthless and will never be worth anything, which is why the owner stopped paying the property taxes in the first place.

    How is custody of the crypto keys managed? Does Equity own and withhold the keys until transferred to something else, or does Equity own but disclose the keys, or are they owned by the customer but Equity withholds the keys, or does the customer own them and know what the keys are? Doesn't the entity that knows the keys actually own them in a crypto environment?

    why would investor A receive 50% of the proceeds when his $13000 contribution was basically 13% of the money put into the deal ?

      Investor A and Investor B are NOT considered disqualified persons to one another. They created a joint venture and agreed that the net proceeds would be split 50%/50%. In other words, it was a negotiated agreement.

      Hello, thank you for the question. I believe you are referring to an FSA (Flex Savings Account), an HSA works differently. An HSA you can transfer to another custodian and continue to maintain year over year, growing tax-free.
